What does it do?

  • The Act sets up the Pashupati Area Development Trust, an autonomous corporate body in Kathmandu, to keep the Pashupati area — within boundaries notified by the government — as a centre of Hindu worship and pilgrimage; to plan its protection, upkeep and development; to conserve its ancient, religious and cultural monuments, Pashupatinath's movable and immovable property and natural heritage; to arrange traditional worship and festivals in all Rajguthi temples in the area; and to develop it as an international pilgrimage site. Nepal Law Commission (lawcommission.gov.np), consolidated text Sections 2.1.1, 3–6, PDF pp. 2–4
  • The Minister for Culture, Tourism and Civil Aviation chairs the Trust and its governing council, whose members include the National Planning Commission member for culture, the Mul Bhatta (chief priest) of Pashupatinath and the secretaries of the culture, home and physical infrastructure ministries. The council approves the area master plan, annual plans and programmes, arranges worship and festivals, and fixes rents for the Trust's property. Forests, open land and public structures in the area remain under government control. Nepal Law Commission (lawcommission.gov.np), consolidated text Sections 7–10, PDF pp. 5–10; Section 16, PDF p. 11
  • The Trust may make rules on administration, finance, staff pay and conditions, the Pashupatinath Amalkot Kachahari and Tahabil, and traditional worship, but such rules take effect only once approved by the Government of Nepal. Nepal Law Commission (lawcommission.gov.np), consolidated text Section 21.1, PDF p. 18

Gaps, loopholes and improvement ideas

  • Not enforced Section 21(1) requires the Trust's rules to be approved by the Government of Nepal, but the Auditor General found that the Trust's staff service rules (third amendment, 2065), temple and worship management rules (2068) and financial administration rules (second amendment, 2045) had not been approved by the Council of Ministers. Office of the Auditor General, Nepal · Nepal Law Commission (lawcommission.gov.np), consolidated text OAG 62nd report, Pashupati Area Development Trust para 37 (PDF pp. 578–579, printed pp. 548–549); Act Section 21.1, PDF p. 18
  • Capacity The Auditor General raised concerns about the management of the Trust's property. A dharmashala leased in 2076 for 15 years at Rs 10.54 million a year was found by an inquiry committee to be run contrary to the agreement; the council cancelled the lease in 2078, but a writ was pending in court, the hotel kept operating and no rent had been recovered. Another dharmashala operator owed Rs 9.216 million in rent and fines. According to a 2075 study committee cited by the OAG, 231 ropani of Pashupatinath's 5,060 ropani of guthi land remained unregistered, and 1,161 ropani were being used by Tribhuvan International Airport under an agreement. Office of the Auditor General, Nepal OAG 62nd report, Pashupati Area Development Trust paras 39, 44–45 (PDF pp. 579–581, printed pp. 549–551)
