What does it do?

  • The Act lets the government form the Nepal Special Service to maintain national security, and sets up the National Investigation Department under the Office of the Prime Minister and Council of Ministers (replacing the former Nepal Public Relations Head Office) to run it. The Department's functions, and staff recruitment, promotion and dismissal, are set by regulations, which the government is not required to publish. Nepal Law Commission, Government of Nepal Sections 3–6, pp. 1–2; Section 12, p. 4
  • The government may assign the Department to investigate any matter it considers necessary; investigating officers then have the powers police have under the Police Act 2012, and the government prosecutes wrongdoing that is found. Government offices and individuals must help staff who show a Department identity card. Nepal Law Commission, Government of Nepal Sections 5क–5ख, p. 2
  • Staff cannot be questioned by any body or court about what information they gathered, when, or to whom they gave it (except in prosecutions under this Act), and no one can be forced to disclose the Department's secret documents. Staff must not misuse their position or breach secrecy, even after leaving; violations carry up to ten years' prison or a Rs 10,000 fine plus compensation for losses. Nepal Law Commission, Government of Nepal Sections 7–9, pp. 2–3
  • Offences are tried in camera by a court the government designates in the Gazette, using Special Court procedure; the accused may be detained during investigation on a written record of reasons that cannot be challenged, and appeals go to a three-judge bench of the Supreme Court. Nepal Law Commission, Government of Nepal Sections 10–11, pp. 3–4
