What does it do?

  • The Act governs petroleum exploration and production (crude oil, natural gas and other hydrocarbons) — not the fuel retail trade. All petroleum found anywhere in Nepal, on private or public land, belongs to the government, which holds the monopoly on petroleum operations and may carry them out itself or through domestic or foreign contractors under petroleum agreements; the government may also take a share in contractors' operations. The Department of Mines and Geology handles applications, and a Petroleum Advisory Committee advises the government. Nepal Law Commission (lawcommission.gov.np), consolidated official text Sections 2–8, pp. 1–4
  • Operations must follow good industry practice, protect people, property, forests and the environment, and maximise long-term recovery; all data and permanent installations belong to the government. The government may close areas for security, public interest, heritage or tourism, issue protective orders and inspect operations. Contractors may export their share (subject to temporary bans to meet domestic demand), pay a royalty of at least 12.5 percent plus annual ground rent and other set fees instead of other taxes, receive customs and foreign-exchange concessions, employ foreigners, and get access to land. Nepal Law Commission (lawcommission.gov.np), consolidated official text Sections 5, 9–17, pp. 3–6
  • Operating without a petroleum agreement leads to closure, confiscation and a fine of up to Rs 100,000; contractors who ignore orders or fail to report face suspension of concessions, fines and compensation claims, and obstructing licensed work is punishable by up to six months' prison or a Rs 1,000 fine or both, with appeal to the High Court within 35 days. Other contract disputes go to arbitration under the agreement. Refining petroleum needs a permit from the Department. Nepal Law Commission (lawcommission.gov.np), consolidated official text Sections 19–21, pp. 6–8
