What does it do?
- This Act gives legal standing in Nepal to the International Centre for Integrated Mountain Development (ICIMOD), set up under a 30 September 1981 agreement between the Government of Nepal and UNESCO to study and support the integrated development of the Hindu Kush–Himalayan mountain region. The Centre is a fully autonomous body with international personality and perpetual succession; it takes direction only from its Board of Governors, may own property and sue or be sued, runs on a non-profit basis and is to stay free from politics in management and staff recruitment. Nepal Law Commission Section 2(b)–(c), Section 3(1)–(4), pp. 1–2
- The Centre's offices, premises, property, records and documents are inviolable. Its capital, income and property are exempt from tax; it may import and export goods it needs free of customs and other duties, claim back duty on goods it buys locally, and hold and move foreign currency, under procedures agreed with the Government. Nepal Law Commission Sections 6–12, pp. 3–5
- Board members, the Director and the Deputy Director receive the privileges and immunities given to diplomats; other staff, and UNESCO and foreign-government representatives attending the Centre's meetings, receive those under the 1947 UN Convention on the Privileges and Immunities of the Specialized Agencies (to which Nepal has been a party since 28 September 1965), and representatives get free visas. The Centre must give the Ministry of Foreign Affairs the names, posts and nationality of those covered. Nepali citizens do not get these privileges. Nepal Law Commission Sections 13–14, pp. 5–6
- Safeguards: if the Centre sells or hands over goods that were exempted from duty, it must pay the duty due at the current value, and restricted goods may be sold only to the Government or a buyer it approves. Staff are not personally liable for official acts, but a person harmed by staff negligence or deliberate acts may claim compensation from the Centre through the Government, and the Centre must arrange compensation (for example through insurance). The Centre may not give asylum to anyone sought under Nepali law or for extradition, must prevent misuse of its privileges, and on dissolution its assets are dealt with under the Act. Nepal Law Commission Sections 15–19, pp. 6–7
