What does it do?
- The Act creates the National Trust for Nature Conservation (originally the King Mahendra Trust for Nature Conservation, renamed in 2063) as an autonomous corporate body with perpetual succession that can own property and sue or be sued. Its job is to conserve, promote and manage wildlife and other natural heritage, help develop national parks and reserves, and carry out scientific research on wildlife and nature. Nepal Law Commission, Government of Nepal Section 3, p. 2; Section 9, p. 3; editorial note, p. 5
- The Prime Minister is the Trust's patron and nominates its chair. The chair nominates the rest of the board for five-year terms: three government secretaries, three representatives of government or non-government bodies, four representatives of international organisations or internationally known individuals, three other people, and a member-secretary. The chair may remove any member who does not perform their duties properly. The board normally meets once a year. Nepal Law Commission, Government of Nepal Sections 4–8, pp. 2–3
- The Trust is funded by government grants, money from national and international organisations, and other sources, and may raise donations through foreign and international bodies. Its funds must be kept in Nepal Rastra Bank or another bank. Its accounts are audited by the Auditor General, and the government may inspect its books at any time. Cases involving the Trust start in the High Court. It deals with the government through the Ministry of Forests and Environment and the Department of National Parks and Wildlife Conservation. Nepal Law Commission, Government of Nepal Sections 10 and 12–14, pp. 3–4; Section 18, p. 5
Gaps, loopholes and improvement ideas
- Capacity Unrecovered loans and spending above income at some units. The Auditor General reported that in FY 2080/81 the Trust and its eight units earned Rs 1.164 billion and spent Rs 938.99 million. However, four units, other than the Annapurna and Manaslu Conservation Area Projects, the Koshi Conservation Centre and the Central Zoo, spent Rs 42.28 million more than they earned. The Manaslu Conservation Area Project had long ago lent Rs 5.72 million to seven people and organisations to build micro-hydro projects, and the loans had not been repaid. Office of the Auditor General, Nepal OAG 62nd Annual Report, Ministry of Forests and Environment chapter, National Trust for Nature Conservation, paras 28–29, printed p. 452 (PDF p. 482)
Ideas to fix it
- Control administrative spending, and recover the principal and interest of the Manaslu Conservation Area Project's loans as the loan agreements require. Proposed by: Office of the Auditor General (62nd Annual Report) Office of the Auditor General, Nepal
