What does it do?
- The Act regulates medicines to stop their misuse and false advertising and to ensure they are safe, effective and of good quality. The Department of Drug Administration carries out all drug control under the Act, advised by a Drug Consultative Council and a Drug Advisory Committee, with the National Medicines Laboratory testing drugs. Nepal Law Commission (lawcommission.gov.np), consolidated text Preamble, PDF p. 1; Sections 3–6, PDF pp. 4–5
- A drug factory needs the Department's recommendation before it is set up and a product licence before it produces; drug imports and exports need the Department's recommendation; and anyone selling drugs must register their name and shop and may sell only registered drugs. Licences must be renewed. A 2079 amendment lets the government authorise emergency use of drugs or vaccines during an epidemic. Nepal Law Commission (lawcommission.gov.np), consolidated text Sections 7–11, PDF pp. 5–8
- Every drug must meet set standards; producing, selling, importing, storing or administering substandard drugs, adulterating drugs, selling expired drugs and misleading advertising are banned, and advertising a drug needs a permit. Inspectors may inspect, search and seal suspect drugs. With government approval, the Department may fix the price of any drug and must publish it in the Nepal Gazette. Nepal Law Commission (lawcommission.gov.np), consolidated text Sections 12–14, 19–20, PDF pp. 8–12; Section 26, PDF p. 13; Sections 29–30, PDF p. 14

The Government of Nepal is the plaintiff. Nepal Law Commission (lawcommission.gov.np), consolidated text Section 34, PDF pp. 15–16; Section 38, PDF p. 17
Gaps, loopholes and improvement ideas
- Outdated The High-Level Economic Reform Suggestion Commission found the Act too narrow: there is no law or institutional arrangement to regulate nutraceuticals and other health supplements, cosmetics that contain drug-like chemicals, or home health devices such as glucose and blood-pressure meters. It said Nepali drug makers cannot get permission to produce such products while unregulated imports dominate the market, and consumers have been cheated by substandard devices. High-Level Economic Reform Commission (उच्चस्तरीय आर्थिक सुधार सुझाव आयोग), submitted to the Ministry of Finance Legal reform chapter, para 22 (PDF pp. 156–157, printed pp. 89–90)
- Not enforced The Auditor General noted that market monitoring covers only part of the sector. In FY 2081/82 the Department of Drug Administration inspected 2,791 of 31,358 registered pharmacies and drug sellers; of 33,299 registered sellers only 15,034 had renewed and 3,847 registrations had been cancelled, raising the risk that drugs are sold from pharmacies whose registration has lapsed. Only 55 of 84 drug manufacturers selling in the market held national Good Manufacturing Practice certificates. Office of the Auditor General, Nepal OAG 63rd report, Department of Drug Administration, paras 31–33 (PDF pp. 564–565, printed pp. 532–533)
- Not enforced Section 26 requires drug prices set by the Department to be published in the Nepal Gazette, but the Auditor General found that of 117 drugs priced in the past, prices for only 96 had been published. It also found that the Department still regulates drugs under the 1978 Act and rules approved between 2037 and 2043 BS, without updating production, sales and quality-control standards. Office of the Auditor General, Nepal · Nepal Law Commission (lawcommission.gov.np), consolidated text OAG 63rd report, Department of Drug Administration, paras 36–37 (PDF p. 565, printed p. 533); Act Section 26, PDF p. 13
Ideas to fix it
- Replace the Drugs Act with a new 'Drugs and Health Products Regulation Act' covering the production, import, marketing and sale of drugs, drug-like supplements, cosmetics, medical devices and human-cell-based products for transplantation — modelled on laws such as Japan's 2020 Pharmaceuticals and Medical Devices Act. Proposed by: High-Level Economic Reform Suggestion Commission (2081) High-Level Economic Reform Commission (उच्चस्तरीय आर्थिक सुधार सुझाव आयोग), submitted to the Ministry of Finance
- Update production, sale and quality-control standards in line with good practice, publish all set drug prices in the Gazette, and widen inspection of pharmacies. Proposed by: Office of the Auditor General (63rd Annual Report) Office of the Auditor General, Nepal
