What does it do?

  • The Act aims to curb competitive spending on social ceremonies — weddings, sacred-thread and rice-feeding ceremonies, birthdays and death rites. It bans tilak and dowry demands: the groom's side may not demand or receive cash or goods, the bride's side may not take money for giving a daughter in marriage, and gifts beyond the jewellery worn plus up to Rs 10,000 are not allowed; the groom's side may not refuse or delay the marriage over dowry. Breaches are punishable by confiscation of the amount involved, fines (up to Rs 40,000 depending on the offence) and short prison terms. Nepal Law Commission (lawcommission.gov.np), consolidated text Section 2(क), PDF p. 2; Sections 3–6, PDF pp. 2–3
  • It also limits wedding processions to 51 people including musicians (no more than 11 musicians, no hired dancers, no fireworks), and caps guests outside close relatives at 51 for wedding feasts and 25 for other ceremonies and death rites; ostentatious display of dowry and lavish lighting of houses are banned. The government may set spending ceilings by Gazette order. Nepal Law Commission (lawcommission.gov.np), consolidated text Sections 7–12, 14, PDF pp. 4–5
  • Local governments must first counsel people planning a prohibited act and report to police if they persist. The Chief District Officer can demand the guest list and other details within 15 days of a complaint. Police investigate, cases must be filed within 35 days, the Chief District Officer tries them using Special Court procedure, and appeals go to the district court; the Government of Nepal is the plaintiff. Nepal Law Commission (lawcommission.gov.np), consolidated text Sections 13, 15–19, PDF pp. 5–6

Gaps, loopholes and improvement ideas

  • Outdated The High-Level Economic Reform Suggestion Commission found that the Act's limits on wedding processions, guests, ceremonies, death-rite feasts and decorations, and the duty to show spending to the Chief District Officer, are not followed in practice, yet have at times been used to target particular people or to send security personnel to harass wedding parties. It judged the Act wholly irrelevant today and noted that spending on consumption drives economic activity and jobs. High-Level Economic Reform Commission (उच्चस्तरीय आर्थिक सुधार सुझाव आयोग), submitted to the Ministry of Finance Legal reform chapter, para 19 (PDF pp. 155–156, printed pp. 88–89)
