What does it do?
- The Act bans cultivating, producing, preparing, buying, selling, importing, exporting, transporting, storing or consuming cannabis, and cultivating opium or coca and producing, manufacturing, selling, trading or (except cannabis) consuming other narcotic drugs. Exceptions: the government may by rules allow licensed collection and trade of charas from wild cannabis in the western hills for a set period; precursor chemicals may be handled only in quantities permitted by the Chief Drug Control Officer; and people may use narcotic drugs bought from a licensed shop on an approved doctor's prescription. Doctors must not prescribe them unnecessarily or in excess. Nepal Law Commission, Government of Nepal Section 4, pp. 5–6; Sections 5–5B, p. 6
- Penalties are graded by drug and quantity: from up to one month's imprisonment or a Rs 2,000 fine for consuming cannabis, up to 2–10 years and up to Rs 100,000 for dealing in more than 10 kg of cannabis, and up to 15 years to life imprisonment and a fine of Rs 500,000–2.5 million for trading more than 100 grams of opium- or coca-derived drugs. A person found with drugs must prove lawful possession. Owners who knowingly allow their house, land or vehicle to be used may be jailed and the property confiscated; repeat offenders face added punishment, and a government employee who takes a bribe to help drug trafficking gets half the trafficker's punishment in addition. Nepal Law Commission, Government of Nepal Section 12, p. 11; Section 14, pp. 11–14; Sections 15–16, p. 14; Section 21(3), p. 18
- Users can be steered to treatment instead of punishment: a court may withhold punishment for users who are admitted to a treatment centre with reports every 15 days, people undergoing treatment at a government-run or government-recognised rehabilitation centre are not punished, and first-time possession of small amounts of cannabis or medicinal opium for personal use may be settled by a written undertaking. Twenty per cent of fines goes to treatment centres and the government may give twenty per cent as a reward to enforcement staff. Nepal Law Commission, Government of Nepal Section 14(1)(a), (e), (h) provisos, pp. 11–14; Sections 18D–18E, p. 17; Sections 19–19A, pp. 17–18
- Enforcement sits with a Drug Control Administration under the Ministry of Home Affairs, headed by the Chief Drug Control Officer. Investigation officers have police powers, customs officers' search powers and postal censorship powers, may carry weapons, and may hold suspects in police custody for up to three months with the court's approval (one month at a time). Cases are prosecuted by the State and, except cannabis cases under Section 4(a), heard by a court designated by the government in the Nepal Gazette using Special Court Act procedures, with appeal to the High Court. Nepal Law Commission, Government of Nepal Section 21, p. 18; Sections 21A–21C, p. 19; Sections 22 and 22C, p. 20
Gaps, loopholes and improvement ideas
- Outdated The 1976 Act has not been replaced or updated as planned. The Home Administration Reform Action Plan 2078 said more than 12 Acts would be drafted or amended within one year, including a new Narcotic Drugs and Psychotropic Substances Control Act. The Auditor General reported in two successive years that this had not happened; four years into the plan the new Act had still not been drafted. It also listed the Narcotic Drugs Control Act, 2033 among Home Ministry laws not yet amended to fit the federal structure. Office of the Auditor General, Nepal · Office of the Auditor General, Nepal OAG 63rd Annual Report, Ministry of Home Affairs chapter, paras 8–9, printed pp. 264–265 (PDF pp. 296–297); OAG 62nd Annual Report, Ministry of Home Affairs chapter, paras 9–10, printed p. 303 (PDF p. 333)
- Outdated Policy commitments on treatment and on medicinal cannabis have not been put into law. The Auditor General notes that the government's 2081/82 policy and programme promised to set up drug treatment and rehabilitation centres in collaboration with provinces and local levels, and to make policy and legal arrangements to encourage medicinal use and regulated production and commercialisation of cannabis, but these had not been implemented. Under the current Act cannabis cultivation and trade remain prohibited (Section 4(a)). Office of the Auditor General, Nepal · Nepal Law Commission, Government of Nepal OAG 63rd Annual Report, Ministry of Home Affairs chapter, para 6, printed p. 263 (PDF p. 295); Act s. 4(a), p. 5
