What does it do?
- No person, government or non-government office or organisation may raise donations from the public, except voluntary gifts of no fixed amount given for religious, charitable or other public purposes with the prior approval of the federal or a provincial government. Organised fund-raising for education, social organisations and other development work may be done only through a donation collection committee formed under the Act. Nepal Law Commission (lawcommission.gov.np), consolidated text Section 3(1)–(2), PDF p. 2
- The federal government (up to 11 members) or a provincial government (up to 7 members) may form a donation collection committee by notice in the Gazette, including representatives of local chambers of commerce and educational organisations. Before collecting, the committee must get government approval for the amount, the collection method and the project the money will fund. Nepal Law Commission (lawcommission.gov.np), consolidated text Sections 4–5, PDF p. 2
- Donations must be collected only against serially numbered, printed receipts in triplicate (one copy to the donor, one kept by the collector and one for the Office of the Auditor General). Accounts must follow government financial rules, be audited at least once a year by an auditor appointed by the Auditor General, and the audit report and an annual statement of income, spending and work done must be published. Cash must be deposited in a bank or treasury office account. Nepal Law Commission (lawcommission.gov.np), consolidated text Section 6, PDF p. 3; Section 7, PDF pp. 3–4; Section 10, PDF p. 4
- Donations may be used for another purpose only with approval of the government that formed the committee. Collecting donations in breach of the Act or by coercion is punishable by up to two years in prison or a fine of up to Rs 2,000, or both, and the money collected is recovered as a government dues. The Government of Nepal is the plaintiff and the District Court hears these cases. Nepal Law Commission (lawcommission.gov.np), consolidated text Section 9, PDF p. 4; Sections 13–14, PDF p. 5
Gaps, loopholes and improvement ideas
- Outdated In both its 62nd and 63rd annual reports, the Auditor General listed the Donation Act, 2030 among home-administration Acts and regulations that 'have not been amended to fit the federal structure'. (A 2075 amendment let provincial governments form donation committees; the OAG did not say which provisions still need changing, and the Act gives local governments no role.) Office of the Auditor General, Nepal · Office of the Auditor General, Nepal OAG 63rd report, Home Affairs chapter para 9 (PDF p. 297, printed p. 265); OAG 62nd report, Home Affairs chapter para 10 (PDF p. 333, printed p. 303); Act Sections 3–4, PDF p. 2
