What does it do?
- The Act deals with 'jhora' land: forest land in Morang, Sunsari and Jhapa districts that was lawfully cleared and settled. It applies in the jhora areas named by Gazette notice (the first notice brought it into force there from 2028/08/01). Nepal Law Commission, Government of Nepal Sections 1–2, pp. 1–2
- Where jhora land was being farmed by settlers ('raiti') rather than by the registered landholder, the landholder's rights end. The government pays the former landholder compensation of up to five times the land revenue, except for land never lawfully registered. Nepal Law Commission, Government of Nepal Section 3, p. 2
- The land is sold, at a price and in instalments set by the designated officer, to the settlers who farm and live on it, generally up to four bigha per family depending on family size, with any remainder sold to other eligible people; it is then registered in the buyer's name. Buyers cannot sell or give away the land until they have paid in full. Nepal Law Commission, Government of Nepal Sections 4–6, pp. 2–3
- The designated officer uses Special Court procedure for disputes and may confiscate land (and money paid) obtained by false statements or held in breach of the conditions; obstructing the work can bring a Rs 1,000 fine or up to one year's prison. The officer's decisions cannot be challenged in court, though the government may review them on complaint. Nepal Law Commission, Government of Nepal Sections 7–9, p. 4
