What does it do?

  • The Act (2027 BS, i.e. 1971 AD) sets the certificates and logbooks that every Nepali sea-going ship must carry. It applies to ships of at least 10 gross register tons registered or required to be registered under the Ships Registration Act 2027, and to their owners, crew and staff wherever they are. Certificates and logbooks must be in Nepali (English may be added as a second language), kept on board at all times and shown to the Nepal Ships Office or Nepali diplomatic or consular officials on request. Nepal Law Commission (lawcommission.gov.np), consolidated official text Preamble; Sections 1–3, pp. 1–4
  • Each ship must carry its registration certificate (or a temporary nationality certificate), a crew list with each sailor's name, age, qualifications and citizenship and the minimum safe crew, a tonnage certificate and a rat-eradication or exemption certificate. Safety certificates based on the International Convention for the Safety of Life at Sea (SOLAS) 1960 — for passenger ships, for cargo-ship construction, equipment and radio according to tonnage, seaworthiness and international load line — are issued by the Nepal Ships Office or a recognised navigation inspector on the basis of a classification society's certification. Most safety certificates are valid for one year, extendable by up to 150 days for seaworthiness. Nepal Law Commission (lawcommission.gov.np), consolidated official text Sections 4–10, pp. 4–7
  • Larger ships must keep a ship's logbook (navigation, weather, major incidents), an engine logbook, a sanitation logbook (ships of 400 tons or more, including crew and passenger health and vaccination), a radio logbook and a cargo book. Logbooks are kept on board for one year after use and then lodged with the Nepal Ships Office, which keeps them for 10 years; papers of ships whose registration is cancelled must also be lodged, unless the ship was transferred abroad. Nepal Law Commission (lawcommission.gov.np), consolidated official text Sections 11–16, pp. 7–10
  • Fines are modest: up to Rs 8,000 for letting a ship sail without the required certificates and logbooks, up to Rs 1,500 for sending a ship to sea without logbooks or with expired certificates, up to Rs 1,000 for a master who fails to keep or produce papers, and up to Rs 500 for crew who fail in their duties. Cases are decided by the Registrar of the Nepal Ships Office with district-court powers, with appeal to the District Court within 35 days. Nepal Law Commission (lawcommission.gov.np), consolidated official text Sections 17–18, pp. 10–11
