What does it do?

  • The Act gives foreign states and their diplomatic missions in Nepal the privileges and immunities recognised by international law and practice. Mission premises are inviolable: Government officials may not enter without the head of mission's permission, and the Government must protect them from intrusion, damage or disturbance. Mission archives and official correspondence are inviolable, and mission premises owned or leased by the foreign state or head of mission are exempt from taxes. Nepal Law Commission Preamble; Sections 3–6, pp. 1–3
  • Diplomatic agents are personally inviolable, as are their private homes, and are immune from Nepal's criminal, civil and administrative jurisdiction, except in cases about their private immovable property in Nepal, private inheritance matters, or commercial activity outside their official functions; they cannot be compelled to testify. They are exempt from most taxes and, under Government notices, from customs duties. Family members, administrative and technical staff, service staff and private servants receive graded privileges. Nepal Law Commission Sections 7–16, pp. 3–7
  • Diplomats who are Nepali citizens or permanent residents get immunity only for official acts unless the Government grants more. By Gazette notice the Government may grant additional privileges, and may extend the Act's privileges to other foreign nationals, international organisations and their staff, and consuls; it grants privileges on a reciprocal basis as far as possible. Nepal Law Commission Sections 17–18, p. 7
