What does it do?
- The Act (the Motion Pictures (Production, Exhibition and Distribution) Act) requires a licence from the officer designated by the federal government to produce, distribute or exhibit feature films and other film types the government notifies. Building and running a cinema hall needs a licence from the provincial government, which considers nearby schools, hostels and hospitals, local need and audience safety, plus building approval from the municipality; the hall must be built within two years (extendable by one year) or the licence lapses. The Chief District Officer may inspect halls and stop screenings that are unsafe or unlawful. Nepal Law Commission (lawcommission.gov.np), consolidated official text Sections 3–6, pp. 3–5
- Every film must be submitted to the Film Censor Board formed by the government before public screening; the Board may approve it, require cuts, restrict it to viewers over 16, or refuse it if it harms national security, peace and order, relations with friendly countries or communities, public decency or morality, defames anyone, is in contempt of court, or encourages gender violence or crime. Decisions can be appealed to the government within 35 days, and the government may itself stop a screening for peace and order after a hearing. Cinemas must play a Nepali record at the start and interval and, where possible, show documentaries on science or current events, and must show documentaries the government orders; ticket rates are set by the province; a Film Development Board promotes the industry. Nepal Law Commission (lawcommission.gov.np), consolidated official text Sections 7–11, pp. 5–8
- Breaching the Act or rules can lead to a fine of up to Rs 5,000 imposed by the Chief District Officer and cancellation of the licence; making, distributing or showing films without a licence can also lead to confiscation of the film and equipment, with appeal to the district court. Nepal Law Commission (lawcommission.gov.np), consolidated official text Section 12, p. 8
