What does it do?

  • Without permission from the Government of Nepal, no one may run, print or publish a lottery, sell or distribute lottery tickets, print or distribute lottery advertisements, bring foreign lottery tickets or advertisements into Nepal (unless exempted by the government), send lottery proceeds abroad, or let a house or land be used for lottery business. Nepal Law Commission, Government of Nepal Section 2(क)–(ङ), pp. 1–2
  • A person or organisation must apply to the government with full details, and the government may grant permission if it finds the lottery reasonable. Only organisations may run lotteries for charitable or public-interest work; at least 60 per cent of ticket sales must go to prizes and the rest may be used for the charitable work and running the lottery. Other lotteries may not give cash prizes and must distribute goods worth 75 per cent of sales as prizes. Every ticket must show its price, prizes, draw place and dates, the organiser's name, serial number and the date of permission, and the government may fix the maximum total capital and ticket price by notice in the Nepal Gazette. Nepal Law Commission, Government of Nepal Section 3(1)–(3), pp. 2–3
  • If not all tickets are sold by the closing date, the organiser may reduce the prizes in proportion to the tickets sold. Tickets must be sold at full price, all at the same price, and once sold cannot be returned; a lottery permitted at an exhibition, club or similar venue may be sold only there. Nepal Law Commission, Government of Nepal Section 3(2)(घ)–(छ), p. 3; Section 4, p. 4
  • Police officers authorised by a police officer of Sub-Inspector (naayab nirikshak) rank or above may arrest suspects, search premises and seize items connected with an offence. Breaking the Act is punished by confiscation of the amount involved and a fine of the same amount, or up to six months in prison, or both. The government may delegate its permission power to an officer named in the Gazette and may make rules. The 1968 Act has been amended once (2066) and the text summarised is that consolidated version. Nepal Law Commission, Government of Nepal Sections 5–8, p. 4; title page, p. 1
