What does it do?

  • The Act provides for vaccinating children (under 12) against smallpox in the areas where the government applies it by Gazette notice. Every unprotected child must receive a primary vaccination before six months of age and be revaccinated at intervals of no more than three years until age 12, or immediately when an outbreak is notified; guardians must report changes of residence and bring children for inspection after vaccination. Nepal Law Commission (lawcommission.gov.np), consolidated official text Preamble; Sections 1–2, pp. 1–2; Sections 7, 9–11, pp. 3–4
  • Vaccination may be given only by government-appointed or licensed vaccinators under vaccination superintendents, free of charge at vaccination centres; children who are unwell may be certified as temporarily exempt. Doctors and guardians must report smallpox cases, and using material that causes smallpox (variolation) instead of vaccine is banned, as is mixing with others within 40 days of it without a certificate. Nepal Law Commission (lawcommission.gov.np), consolidated official text Sections 4–6, 8, 12–14, pp. 2–5
  • The local authority (the Chief District Officer unless the government designates another) hears cases. Vaccinating without a licence or using banned material is punishable by up to six months' prison or a Rs 300 fine or both (doubled for repeat offences); guardians who ignore notices or orders face fines of up to Rs 50, then Rs 100. Nepal Law Commission (lawcommission.gov.np), consolidated official text Section 2(झ), p. 2; Sections 15–18, pp. 5–6
