What does it do?

  • When an infectious disease breaks out or threatens to spread among people anywhere in Nepal, the Government of Nepal may take any action needed to eradicate or prevent it and issue orders that apply to the public or to any group. It may appoint officials and give them the necessary powers, and order the inspection of travellers by foot or vehicle, isolating suspected cases in hospitals or other places and controlling their movement. Nepal Law Commission (lawcommission.gov.np), consolidated text Section 2, PDF p. 2
  • Since a 2075 amendment, provincial governments have the same powers within their province. Where the federal government has already issued an order, the province does not issue its own but implements the federal order, and a province must inform the federal ministry immediately of any order it issues. Nepal Law Commission (lawcommission.gov.np), consolidated text Section 2क, PDF pp. 2–3
  • Disobeying the Act or an order under it is punishable by up to one month in prison or a fine of up to Rs 100, or both; obstructing authorised officials, by up to six months or Rs 600, or both. The Chief District Officer hears these cases, and officials acting in good faith are protected from legal action. Nepal Law Commission (lawcommission.gov.np), consolidated text Sections 3–5, PDF p. 3
