What does it do?

  • The Act establishes Gorkhapatra Corporation, which began operating on 2020-03-25 BS, as an autonomous corporate body with perpetual succession and its head office in Kathmandu. Its duty is to publish and distribute healthy, responsible and entertaining newspapers and magazines that bring domestic and foreign news and other useful information to the public across Nepal in a simple, accessible and affordable way, including printing and publishing the Gorkhapatra daily and The Rising Nepal. Nepal Law Commission Sections 3, 17, pp. 2–3, 7
  • The Government must hold at least 51 percent of the shares, up to 25 percent may go to employees, and the rest may be sold to the public; only Nepali citizens and Nepali companies or cooperatives may hold shares. A five-member board runs the Corporation: the General Manager, a director elected by private shareholders, a Government nominee for its shares, a Government nominee known in journalism, publishing or literature, and an employee-shareholder; until a general meeting exists, the Government nominates all of them. The Government appoints the chair, and directors serve four years. Nepal Law Commission Sections 4–5, 8, pp. 3–5
  • The Government keeps strong control: the Corporation needs prior approval to buy property worth over Rs 10 million, mortgage property for over ten years or sell assets worth over Rs 500,000; it must submit its annual programme and budget three months before the fiscal year; it may not take foreign loans or grants without approval; and the Government may issue binding directions and order inquiries into its work. Nepal Law Commission Sections 6, 18–19, 21–22, pp. 4, 10–12
  • The Corporation keeps its own fund and accounts. Its accounts are audited by an auditor appointed by the Government and one chosen by shareholders (only the Government's auditor until a general meeting exists), and profits are distributed and used as prescribed. Nepal Law Commission Sections 23–27, pp. 12–14
