What does it do?

  • Enacted in the Panchayat era, the Act gives the government power to guide 'class and professional organisations' (children's, youth, women's, peasants', workers' and similar organisations) towards national development. No such organisation may be formed without the government's prior approval of its constitution, which the government may amend, refuse without giving reasons if it finds the organisation not aimed at its stated purpose or against the national interest, and only one organisation per class or profession may be approved where the government has formed or recognised one. Nepal Law Commission, Government of Nepal Preamble; Sections 2–3, pp. 1–3
  • Students may form unions in universities, colleges and schools only with the approval of the vice-chancellor, principal or head teacher, and those who form one without approval or break its rules can be expelled for up to two years, during which no school or college in Nepal may admit them. Nepal Law Commission, Government of Nepal Section 3(8), pp. 3–4
  • The government may issue binding national directions to class, professional and other organisations on their work and activities, and may delegate these powers by Gazette notice. Forming an organisation without approval can bring a fine of up to Rs 500 or six months' prison, and the organisation is illegal; breaching the Act can lead to a fine or the organisation's suspension or dissolution. Government orders under the Act are final and cannot be questioned in court. Nepal Law Commission, Government of Nepal Sections 5–6 and 8, pp. 4–5
