What does it do?
- The Act (2018 BS, i.e. 1961 AD) regulates explosives. The government may declare by Gazette notice any substance that can endanger life or property through explosion to be an explosive. Anyone wishing to manufacture, store, use, sell, transport or import explosives must obtain a licence, applying to the Chief District Officer, who may also amend licences; licensees must keep records of every batch made or traded (purpose, quantity and buyer) and make them available to the CDO and investigators, and must take adequate safety precautions in use, transport and storage. Nepal Law Commission (lawcommission.gov.np), consolidated official text Sections 3–4ख, pp. 3–5
- For public safety the government may wholly or partly ban the manufacture, use, sale, transport or import of any explosive. The Chief District Officer or authorised officials may inspect, search, seize and remove explosives, and arrest suspects with a warrant from the adjudicating officer (or without one in urgent cases, producing them within 24 hours). Explosions or fires causing death or serious damage must be reported to the nearest police; the Army investigates accidents in its areas and the CDO elsewhere, with court-like powers. Nepal Law Commission (lawcommission.gov.np), consolidated official text Sections 5–9, pp. 5–7
- Making, storing, using, selling, transporting or importing explosives without a licence carries up to two years' prison or a Rs 20,000 fine for high explosives such as nitroglycerine, dynamite or blasting powder, up to one year or Rs 10,000 for other explosives, and up to Rs 1,000 for fireworks; breaching licence conditions carries lower fines, and expired licences count as no licence. The Act does not apply to the Nepal Army or to government bodies under their own rules, does not displace the arms and ammunition law, and allows prosecution under other laws. Nepal Law Commission (lawcommission.gov.np), consolidated official text Sections 10–13, pp. 7–9
