What does it do?
- The Act lets the Government of Nepal and, since the 2075 amendment, provincial governments control the production, distribution and trade of 'essential goods' to keep supplies available and fairly distributed. Essential goods include rice and other grains, pulses, edible oils, milk products, sugar, cloth and cotton, jute, kerosene, petrol, diesel and lubricants, iron and steel, cement and other building materials, vehicle parts, salt, medicines, and anything else the Government declares by notice. Nepal Law Commission Sections 2(a)–(b), 3(1), pp. 2–3
- By an order published in the Gazette, a government may license or control the storage, distribution, transport, production, trade and consumption of an essential good; fix buying or selling prices or ban price rises without approval; require traders who refuse to sell to do so; force hoarders to sell their stock to named buyers; restrict or ban trade in the public interest; demand records and information; take licence deposits; and search warehouses and vehicles and seize goods. The federal Government may set standards that provincial orders must follow. Nepal Law Commission Sections 3(2), 3A, 8, pp. 3–4, 6–7
- Breaking such an order is punishable by up to five years' imprisonment or a fine of up to Rs 15,000 or the value of the goods involved (whichever is higher), and the goods may be confiscated; giving false statements or keeping false accounts carries up to Rs 10,000 and/or three years. When a company commits an offence, its directors or managers are also liable unless they show they tried to prevent it. Cases are brought by the Government in the District Court, with appeal to the High Court, and informants receive a reward when an offender is convicted. Nepal Law Commission Sections 4–7A, 10, pp. 4–7
