What does it do?
- The Act protects fish and other aquatic animals in all waters in Nepal: rivers, lakes, ponds, canals, reservoirs, wetlands, fish cages and fish-farming paddy fields. Nobody may use electric current, explosives or poison to catch or kill aquatic animals; only 'safe poison' (chemicals or herbs recommended by a fisheries technical officer) may be used where poison is needed. Owners of private ponds may use other methods in their own water as long as they do not harm aquatic life elsewhere. Nepal Law Commission, Government of Nepal Section 2, p. 2; Sections 3 and 5क, pp. 3–4
- The government may, by Gazette order, ban catching or killing specified species, or any aquatic animals during specified seasons or in specified waters, without permission; in such waters all aquatic life belongs to the government. Bodies building dams for electricity, drinking water or irrigation must build fish ladders where possible, or otherwise provide hatcheries and nurseries for artificial breeding, and no one may block or break fish ladders or dam gates. Outside these bans, citizens remain free to fish. Nepal Law Commission, Government of Nepal Sections 3क–6, pp. 3–5
- The government may let fishing contracts in waters under its control, and local levels may let contracts for other aquatic animals within federal standards. Nepal Law Commission, Government of Nepal Section 7, p. 5
- The local authority (designated officer) decides cases, may arrest offenders and seize equipment. Using current, explosives or poison, or damaging fish ladders, can bring up to six months' prison or a Rs 5,000 fine plus compensation for damage, assessed with a technical officer; equipment used is confiscated. Appeals go to the District Court within 35 days. Nepal Law Commission, Government of Nepal Sections 8–12, pp. 5–7
