What does it do?

  • This 1958 Act stopped holders of birta land (tax-free land grants) from collecting income from their birta other than the land rent (bali). Under it, birta holders may not lease or collect revenues such as liquor-distillery (bhatti) and hide (charsa) levies on their birta; those revenues belong to the Government of Nepal, which arranges their collection. A transitional rule let birta holders keep 65 percent of such income for 2011/12 to 2013 BS, with the rest payable to the Government. Nepal Law Commission Preamble; Sections 2–3, pp. 1–2
  • Leases of such revenues given earlier by birta holders pass to the Government for their unexpired term, unless they were not properly made or exceed the permitted period. Showing backdated leases, causing loss to the Government, or failing to pay over the income due is punishable by a fine up to the amount involved and/or imprisonment, and the Government recovers the amount. Nepal Law Commission Sections 4–5, p. 2
  • Matters involving these revenues that concern the Government are decided summarily by the Chief District Officer, who has court powers for the purpose (with appeal under Section 7). Private documents that gave anyone a right to such revenues are treated as cancelled from FY 2011/12, and no compensation can be claimed since the revenues are now Government property. Nepal Law Commission Sections 6–8, p. 3

Gaps, loopholes and improvement ideas

  • Outdated The High-Level Economic Reform Commission listed this Act among laws that curtail economic freedom, raise business costs unnecessarily, are prone to misuse, are needlessly control-oriented and are irrelevant in the present context, and recommended repealing it, along with the Birta Abolition Act, 2016. High-Level Economic Reform Commission (उच्चस्तरीय आर्थिक सुधार सुझाव आयोग), submitted to the Ministry of Finance HLERC report, legal reform recommendation 24(च)–(छ), printed p.
