What does it do?
- The Act controls the keeping, making and use of radio equipment in Nepal. 'Radio equipment' is defined broadly to cover devices that send or receive sound, pictures or signals by radio waves without continuous wires — including satellite dishes and receiving systems, radio, TV and wireless transmitters from 30 kHz to 3,000 GHz, walkie-talkies, cordless phones and microphones, amateur radio, Inmarsat and other satellite equipment, radio-controlled toys, radio and TV receivers, and any other device the government names in the Nepal Gazette. Nepal Law Commission (lawcommission.gov.np), consolidated text Sections 1–2, PDF pp. 2–3
- No one may keep, make or use radio equipment without a licence under the Act, except that telecommunications licensees under the Telecommunications Act, 2053 and their customers need no separate licence for equipment used for telecom services. The government may exempt persons, organisations or equipment by rules. Licences are issued by the government or a designated officer for a prescribed fee and term; refusal by an officer can be appealed to the government within 35 days, whose decision is final. Nepal Law Commission (lawcommission.gov.np), consolidated text Sections 3–5, PDF pp. 3–4
- Keeping, making or using radio equipment without a licence leads to confiscation of the equipment and a fine equal to its value; other breaches carry a fine of up to Rs 50,000, doubled for repeat offences. The Chief District Officer may issue search warrants for premises or vehicles suspected of holding such equipment, confiscated and unclaimed equipment goes to the government, and decisions can be appealed to the High Court. Nepal Law Commission (lawcommission.gov.np), consolidated text Sections 6–9, PDF pp. 4–5
