What does it do?
- The Act lets the Government of Nepal prepare a multi-purpose development plan for any area and declare that area a 'development area' by public notice. Once it does, the government can order officials to survey and enter any land there, and can build roads, crossings, canals and similar works needed to carry out the plan. Nepal Law Commission (lawcommission.gov.np), consolidated text Sections 2–3, PDF p. 2
- The government may acquire land inside a development area under the land acquisition law then in force. However, no compensation is paid for land that had been left fallow for up to two years before acquisition, and if the government later sells developed land, the people whose land was acquired with compensation have first right to buy it, under rules the government makes. Nepal Law Commission (lawcommission.gov.np), consolidated text Section 4, PDF p. 2; Section 5, PDF pp. 2–3
- The Act applies even where it conflicts with other Nepali laws, and the government may make rules on how plans are carried out and on the terms on which buyers of developed land may hold it. Nepal Law Commission (lawcommission.gov.np), consolidated text Sections 5–6, PDF pp. 2–3
Gaps, loopholes and improvement ideas
- Outdated The High-Level Economic Reform Suggestion Commission found that the Act is no longer needed in today's context. It noted that under the federal system several municipalities have enacted their own settlement-development and land-pooling laws, and that planned settlements and urban development need a new framework that also lets the private sector pool land and develop modern, well-serviced towns. High-Level Economic Reform Commission (उच्चस्तरीय आर्थिक सुधार सुझाव आयोग), submitted to the Ministry of Finance Legal reform chapter, para 17 (PDF p. 155, printed p. 88)
Ideas to fix it
- Repeal the Act and issue a new Urban Development Act allowing the private sector to pool land or consolidate unplanned settlements for well-serviced, modern urban development. Proposed by: High-Level Economic Reform Suggestion Commission (2081) High-Level Economic Reform Commission (उच्चस्तरीय आर्थिक सुधार सुझाव आयोग), submitted to the Ministry of Finance
