What does it do?
- The Government of Nepal may, by order published in the Nepal Gazette, form a committee to carry out any development plan or work named in the order; the order sets the committee's name and functions, and its members are appointed by the government. Since a 2075 amendment, a provincial government may likewise form a three-member committee by notice in its Provincial Gazette to run plans, projects or bodies transferred to it from the federal government; such a committee is dissolved automatically once the project is completed. Nepal Law Commission (lawcommission.gov.np), consolidated text Sections 2–3क, PDF p. 2
- Each committee is a body corporate with perpetual succession that can hold property and sue and be sued. Its fund consists of money from the government or private donors and funds from foreign agencies given through the government. It works under its own rules, which need approval from the relevant federal or provincial ministry, and it must follow rules and orders issued by the government. Nepal Law Commission (lawcommission.gov.np), consolidated text Sections 4–5, PDF pp. 2–3; Section 7, PDF p. 4
- Committees may hire staff only according to principles and methods approved by the Public Service Commission, and may borrow government officers temporarily. The government may dissolve a committee once its work is done or can be done better by the government itself; its assets and debts then pass to the government. Contract disputes are settled by arbitration, whose decision is final except for limited review by the High Court. Nepal Law Commission (lawcommission.gov.np), consolidated text Section 6, PDF p. 3; Sections 8–9, PDF pp. 4–5
- Many public bodies operate as development committees formed under this Act — for example, the Auditor General's 63rd report describes the Institute of Foreign Affairs and the National Defence University Infrastructure Development Committee as formed under orders issued under it. Office of the Auditor General, Nepal OAG 63rd report, Foreign Affairs chapter (PDF p. 321, printed p. 289) and Defence chapter (PDF p. 406, printed p. 374)
Gaps, loopholes and improvement ideas
Ideas to fix it
- In line with the Public Expenditure Review Commission (2075), restructure federal administration and transfer more bodies — including various development committees — to the provinces now that functions have moved to provincial and local governments. Proposed by: High-Level Economic Reform Suggestion Commission (2081) High-Level Economic Reform Commission (उच्चस्तरीय आर्थिक सुधार सुझाव आयोग), submitted to the Ministry of Finance
