What it does

  • The Public Health Service Act 2075 (2018) puts into law the constitutional right to free basic health services and emergency care. Every citizen has the right to obtain quality health services easily, and no one may be denied health services. Basic services that must be free include immunisation; newborn and child health, nutrition, pregnancy, delivery, family planning, abortion and reproductive health; communicable and non-communicable disease services; mental health; services for senior citizens; general emergency care; health promotion; and Ayurveda and other recognised alternative services. Provinces and local levels may add services at their own cost.   • Every health institution must provide emergency treatment and, if it cannot, give what care it can and refer the patient; costs are met from health insurance or by the patient's family, but services within the basic package must be free.   • The Ministry of Health sets the tiers of health institutions and minimum service standards; private, non-governmental, cooperative and community institutions may operate only with a licence, and those that do not meet the standards or lack a licence are treated as automatically cancelled. The federal government, provinces and local levels may license institutions, with provincial and local laws governing their own licensing.   • The Act also covers wider public health: it bans producing, distributing or broadcasting any advertisement for alcohol, cigarettes, tobacco and other products harmful to health, and misleading health advertising; it requires measures on food and water quality, pollution, sanitation and workplace safety; and it creates a National Public Health Committee.   • Running a health institution or blood transfusion service without a licence, or collecting and taking human biological samples abroad without approval, is punishable by a fine of Rs 1 million, up to two years' imprisonment, or both. Refusing treatment, refusing free basic or emergency care, treating without informed consent, unequal treatment, breach of confidentiality and most other offences carry a fine of Rs 25,000–50,000; treating people with mental illness by chaining or locking them up is punishable by a fine of up to Rs 50,000, up to one year's imprisonment, or both. Gaps, loopholes and improvement ideas

  • Not enforced The ban on alcohol and tobacco advertising is not enforced, and the tax system treats such spending as a deductible business cost. Section 45 bans any advertising of alcohol, cigarettes and tobacco. The Auditor General found that 13 alcohol and tobacco producers under the Large Taxpayers Office claimed Rs 2.32 billion in advertising expenses over 52 income years, and in 2080/81 alone Rs 476.8 million in advertising plus Rs 7.51 billion under headings such as market promotion, sponsorship and brand development; it said allowing these deductions for an activity the law prohibits directly reduces revenue.   • Outdated The rules on who licenses and regulates health institutions have not been updated for federalism. Section 21 leaves the tiers of institutions and minimum standards to the Ministry, and lets provinces and local levels license institutions under their own laws. The Auditor General found the Ministry still relies on the Health Institution Establishment, Operation and Upgrading Standards Directive 2070; provinces have issued their own health service Acts, but the Ministry has not approved policies, laws and standards that demarcate federal, provincial and local jurisdiction as set out in the Constitution and the unbundling report.   • Capacity Free basic services are not fully delivered. Section 3(4) gives every citizen the right to listed basic health services free of charge.   • Capacity Monitoring of private laboratories is thin. Under the Health Laboratory Establishment and Operation Standards Directive 2073, the National Public Health Laboratory must regularly monitor A and B category laboratories. Of 111 such laboratories in its jurisdiction, it monitored 15 in 2081/82, and the Auditor General asked it to expand inspection and ensure that problems found are corrected. Ideas to fix it
