What it does
- The Act puts into practice the powers that the Constitution gives to rural municipalities and municipalities. Their exclusive powers are those in Schedule 8 of the Constitution. The Act then sets out detailed functions, such as municipal police, education, health, roads, water supply and local revenue. - Each municipality has a judicial committee under Article 217 of the Constitution. It decides certain local disputes itself, including irrigation and water sharing, crop damage, grazing, unpaid wages, care of senior citizens, and house rent up to Rs 2.5 million a year (Section 47(1)). Other disputes, such as land encroachment, assault, defamation and nuisance, it may settle only through mediation (Section 47(2)). - The executive must present the budget to the assembly by Asar 10, and the assembly must pass it by the end of Asar. Money left unspent at the end of the fiscal year goes back to the local consolidated fund. - Local governments must have their accounts audited internally and by the Auditor General. They must run an internal control system and hold public hearings, social audits and public audits. - Local staffing is based on an organisation and management survey approved by the assembly. The Chief Administrative Officer is the administrative head. Until one is appointed under law, the federal government deploys a civil servant to the post. - Municipalities may make laws on matters within their jurisdiction. Gaps, loopholes and improvement ideas
- Not enforced Many local governments do not carry out the internal audit that Section 77 requires. - Not enforced The Act requires budgets to be prioritised and based on resource estimates and ceilings, without unallocated lump sums ('abanda'). Even so, the Auditor General found that 219 local levels approved budgets with Rs 7.57 billion left unallocated. - Not enforced Audit objections at local level remain large. In FY 2081/82 the Auditor General audited Rs 1,109.5 billion of spending by 721 local levels and found Rs 21.48 billion in irregularities, of which Rs 19.05 billion was still unsettled. Cumulative unsettled objections at local level stood at Rs 220.47 billion. - Unclear The role of judicial committees is unclear. A Nepal Law Society study, supported by the Australian Government (DFAT) and The Asia Foundation partnership, found that committees read the Constitution and the Act differently: some act as a formal local court, some as a mediation centre, some as a referral desk, and some as a mix of these. It also found that the Act gives too little guidance and support (legal staff, procedures, links to courts and mediation centres). The study warns that because the committee is chaired by an elected deputy mayor or vice-chair who also has executive duties, adjudication and executive functions are blurred, which can create conflicts of interest. - Capacity Staffing at local level is stuck. Ideas to fix it
- Amend the Act to remove the ambiguities and inconsistencies in the judicial committee provisions, then enact procedural law and guidelines. - Expand judicial committee panels from three members to five or seven, and let disputants choose a member from a published roster.
