What it does

  • Only licensed agencies may run a foreign employment business. To get a licence from the Department of Foreign Employment, an agency must lodge a cash deposit and a bank guarantee that rise with the number of workers it plans to send each year (from Rs 5 million cash plus Rs 15 million guarantee for up to 3,000 workers, to Rs 20 million cash plus Rs 40 million guarantee for more than 5,000). A licence lasts one fiscal year and must be renewed.   • The government decides which countries are open for foreign employment and may suspend any of them; it may sign bilateral labour agreements and send workers government-to-government. No one under 18 may be sent abroad for work, and there must be no gender discrimination in sending workers, although an agency may fill a demand that asks only for men or only for women.   • The government sets the maximum service fee and promotion cost an agency may charge per worker for a given country or company. Before departure the contract must be explained clearly to the worker, translated into Nepali and certified by the Department.   • A Foreign Employment Welfare Fund under the Foreign Employment Board is financed by workers' pre-departure contributions, licence fees and interest on agencies' deposits.   • If an employer does not provide work on the agreed terms, the worker can complain to the Department, which may order the agency to repay the full cost of going abroad. Running a recruitment business without a licence, or taking money with false promises of a job abroad, is punishable by repayment of the money plus 50 per cent, payment of travel costs, a fine of Rs 300,000–500,000 and 3–7 years' imprisonment. Gaps, loopholes and improvement ideas

  • Not enforced Compensation orders are slow and their payment is not tracked. In 2080/81 the Department received 7,763 complaints claiming Rs 1.76 billion; it settled 3,849 (49.58%) and set compensation of Rs 309.4 million, 17.53% of the amount claimed, and its records did not show whether Rs 270.7 million of that had been recovered.   • Not enforced Many workers leave without the required skills training. Section 30 requires workers going to jobs that need skills to be trained by a recognised institution.   • Loophole Most countries are opened for recruitment without a labour agreement. Section 3 lets the government open countries for foreign employment, while signing a bilateral agreement under Section 4 is optional.   • Not enforced The cap on what workers pay has long been hard to enforce. Under Section 24 the government sets the maximum fee agencies may charge, and in 2072 (2015) the Labour Ministry decided that employers in seven main destinations must pay workers' visa and air ticket costs; the Auditor General notes that the Supreme Court issued a directive order on 2075/9/18 to implement this 'free visa, free ticket' decision effectively, and recommended making visas and tickets for the main destinations easier and cheaper to obtain.   • Not enforced Money meant for workers' welfare has been spent on other things. Section 33 limits the Welfare Fund to purposes such as training, repatriation, compensation and family support. The Auditor General found the Board spent Rs 3.08 million from the Fund on fairs, festivals, a literary conference and vehicles in 2081/82, and in the previous year reported Rs 41.2 million spent against the Fund's rules on vehicles, travel, fairs and staff posted to missions.   • Loophole Unregistered middlemen have appeared around online services. After the Department moved its services online, private operators set up to fill in online forms began charging fees and filing applications without the required documents, and service users complained of harm.   • Not enforced Licence renewals are not enforced. The Foreign Employment Regulation requires agencies to renew their licence every fiscal year and the licence of any agency that does not renew to be cancelled.   • Capacity Workers find it hard to use the complaint system.   • Outdated Protective conditions on women going abroad for domestic work may be pushing them into irregular routes.
