What it does

  • The Act covers every public body: constitutional bodies, courts, federal and provincial ministries and offices, government-owned companies and corporations, government-funded universities, local levels, and bodies run on government loans or grants. Any procurement that does not follow the Act is void.   • Since the Second Amendment (2083), the winning bid is no longer the lowest one. The evaluation committee takes the average of the qualifying bids and picks the bid closest to that average, provided it is not substantially above the cost estimate. Bids more than 30 per cent below the approved cost estimate are removed from evaluation.   • A bidder who thinks a public body broke the rules can complain to the head of that body within 7 days of finding out, but only about steps before the contract is signed. Above a set value, the bidder can then go to the Public Procurement Review Committee, chaired by a sitting or former High Court judge or a retired special-class officer.   • The Public Procurement Monitoring Office, under the Office of the Prime Minister and Council of Ministers, monitors and regulates procurement.   • The Act has been amended five times. The latest is the Public Procurement (Second Amendment) Act, 2083, certified on 2083/3/25. It followed the Public Procurement (Second Amendment) Ordinance, 2083, published in the Nepal Gazette on 2083/1/17. Gaps, loopholes and improvement ideas

  • Unclear Price adjustment in design-and-build contracts was unclear. The Auditor General found that the Act and Rules did not spell out how price adjustment applies to design-and-build contracts, and the Monitoring Office had not issued bidding documents for them. Because Section 55(2) bars price adjustment in lump-sum contracts, 22 offices under the Ministry of Physical Infrastructure and Transport paid Rs 44.86 crore in price adjustment on 75 such contracts that, in the Auditor General's view, should not have been paid.   • Not enforced Contract remedies are often not used. In FY 2081/82, the Auditor General found that 118 contracts were terminated: for 62 the cost of finishing the work had not been worked out, performance guarantees of Rs 5.42 crore on 17 were not seized, and Rs 5.79 arba ordered to be recovered from contractors on 39 had not been collected. Liquidated damages of Rs 19.98 crore were not collected on 19 late contracts. On 782 projects worth Rs 47.73 arba, work was still unfinished even after deadlines had been extended by up to 300 per cent.   • Not enforced Contract disputes cost public bodies heavily. The Auditor General's special audit of procurement and arbitration found disputes on 160 contracts over five years (FY 2077/78 to 2081/82). Contractors, suppliers and consultants claimed Rs 11.92 arba and USD 12.91 million, and arbitrators ordered payment of Rs 4.45 arba and USD 6.32 million.   • Outdated Before the Second Amendment, the Auditor General recorded weaknesses in the law that the Monitoring Office had itself reported: no national public procurement policy; land acquisition and environmental assessment not covered; no separate rules for national-pride and other large projects; small, urgent purchases for basic services handled the same way as large, complex projects; sale and disposal of government goods and property not covered; and no procurement code of conduct binding suppliers, consultants and officials alike. The report came out before the Second Amendment Act, 2083.   • Capacity The monitoring system lacks capacity. The Auditor General found that the Monitoring Office had not done several tasks the Act and Rules give it: certifying procurement experts, keeping a central database of contract performance, and drafting a code of conduct. It also lacks the staff and capacity to train procurement officers from the centre down to local levels. The Asian Development Bank suspended use of the electronic procurement system on projects it funds until security weaknesses are fixed. Ideas to fix it
