What it does
- The Act sets up a Public Debt Management Office to run government borrowing. The Office projects how much the government needs to borrow each year, within limits recommended by the National Natural Resources and Fiscal Commission. It drafts short-, medium- and long-term debt strategies, issues and auctions government securities in coordination with Nepal Rastra Bank, keeps records of debt and guarantees, and manages the internal debt of the federal, provincial and local governments. The Act replaced the Loans and Guarantees Act, 2025 and the National Debt Act, 2059.यस ऐनले सरकारी ऋण व्यवस्थापन गर्न सार्वजनिक ऋण व्यवस्थापन कार्यालय खडा गरेको छ। राष्ट्रिय प्राकृतिक स्रोत तथा वित्त आयोगले सिफारिस गरेको सीमाभित्र रही कार्यालयले हरेक वर्ष आवश्यक ऋणको प्रक्षेपण गर्छ, अल्पकालीन, मध्यकालीन र दीर्घकालीन ऋण रणनीति बनाउँछ, नेपाल राष्ट्र बैङ्कसँगको समन्वयमा ऋणपत्र जारी र बोलकबोल गर्छ, ऋण र जमानतको अभिलेख राख्छ, र सङ्घ, प्रदेश तथा स्थानीय तहको आन्तरिक ऋण व्यवस्थापन गर्छ। यस ऐनले ऋण तथा जमानत ऐन, २०२५ र राष्ट्र ऋण ऐन, २०५९ खारेज गरेको छ। Nepal Law Commission Sections 3, 4(ka)-(dha) (pp.2-3); Section 29 'Repeal and saving' (p.12)
- Only the federal government may borrow from foreign governments, banks or agencies. Total foreign borrowing for such loans may not exceed one third of the previous year's GDP at current prices. Repayment falls on the Federal Consolidated Fund, unless the loan was taken for a province or local level, in which case it falls on that government's fund.विदेशी सरकार, बैङ्क वा एजेन्सीबाट ऋण लिने अधिकार नेपाल सरकारलाई मात्र छ। त्यसरी लिइने कुल वैदेशिक ऋण अघिल्लो आर्थिक वर्षको चालु मूल्यमा कुल गार्हस्थ्य उत्पादनको एक तिहाइभन्दा बढी हुन पाउँदैन। ऋणको भार सङ्घीय सञ्चित कोषमाथि पर्छ, तर प्रदेश वा स्थानीय तहका लागि लिइएको ऋणको भार सम्बन्धित सरकारको सञ्चित कोषमाथि पर्छ। Nepal Law Commission Section 5(1)-(4) (pp.3-4)
- Federal, provincial and local governments may raise internal debt by issuing bonds within the Commission's recommended limit, but provinces and local levels need the federal government's consent. - The federal government may guarantee loans for approved projects and for public enterprises building licensed infrastructure, and may counter-guarantee subnational internal debt taken with its consent. It must first analyse why the loan is needed, the national interest and the ability to repay. A committee led by the relevant National Planning Commission member, with the finance, law and line-ministry secretaries, makes recommendations. - Loans taken and guarantees given must be shown in the annual budget presented to Parliament, and subnational loans in the budgets presented to provincial assemblies and municipal or rural assemblies. Gaps, loopholes and improvement ideas
- Not enforced Local governments borrow without the required federal consent. The Commission reports that in FY 2082/83, 17 local governments borrowed from the Town Development Fund without federal consent, and the Ministry of Finance said no local government had asked for it. Seven borrowed without putting the loan in their budget, and two municipalities (Rangeli and Urlabari) went over the Commission's borrowing limit. The Auditor General separately recorded that 16 local governments borrowed Rs 37.19 crore from the Fund in FY 2081/82. - Loophole Local governments are guaranteeing other bodies' loans without a legal basis. The Commission found that local levels had acted as guarantors when user groups and similar bodies borrowed from the Town Development Fund, even though no law lets them do this. - Loophole Borrowed money is paying for day-to-day spending. The Auditor General found that in FY 2081/82, Rs 131.39 arba of current (recurrent) spending was paid for with internal loans, including staff, consultancy and office-running costs. It said public debt should go to capital formation. - Not enforced Government on-lending is not being repaid. The Auditor General found that by the end of FY 2081/82, overdue principal on government loans to public enterprises and other bodies had grown 262.82 per cent in a year to Rs 2.59 kharba (49.27 per cent of all such loans). With overdue interest, the total was Rs 4.08 kharba. About 95 per cent of the arrears were owed by ten bodies, including the Nepal Electricity Authority, and some of them were making profits. Ideas to fix it

- Spend borrowed money only on projects with a high internal rate of return, after net present value (NPV) and internal rate of return (IRR) analysis. - Set clear criteria so public debt is used only for high-return infrastructure, productive and job-creating projects.
