What it does
- The Act lists which taxes and fees each level of government may levy (Schedules 1-3). Where the Constitution gives a tax to both provinces and local levels, it splits the work. Provinces set and collect vehicle tax, except on tanga, rickshaws, auto-rickshaws and e-rickshaws, which municipalities and rural municipalities handle. Provinces set the rates of house-and-land registration fees and entertainment tax, and municipalities and rural municipalities collect them. Municipalities and rural municipalities set and collect advertising tax. - VAT and excise on domestic production go into a federal divisible fund. The fund is shared 70 per cent federal, 15 per cent provinces and 15 per cent local levels, paid monthly and reconciled in the last month of the fiscal year. Each province's and local level's share follows the formula set by the National Natural Resources and Fiscal Commission. Vehicle tax is shared 60:40 between a province and its local levels. - The federal government gives four kinds of grants to provinces and local levels. Equalization grants follow the Commission's recommendation, based on spending needs and revenue capacity. Conditional grants follow bases set by the Commission, but the federal government sets the conditions. Complementary (matching) grants for infrastructure, and special grants for basic services, balanced development or disadvantaged groups, follow procedures the federal government decides. Provinces give similar grants to their local levels. - Only the federal government may take foreign grants or loans. Provinces and local levels may not take foreign aid without its prior approval. All three levels may borrow internally within the Commission's limit, but provinces and local levels need federal consent first, and must submit the project, expected returns, repayment plan and lender details. - The Act sets budget rules for all three levels. Provinces must present their budget by 1 Asar and local levels by 10 Asar. No government may run a deficit to pay administrative costs. Money budgeted for capital spending may not be moved to current spending. Accounts must be published within 15 days of audit. - An Intergovernmental Fiscal Council, chaired by the federal Finance Minister and including provincial finance ministers, 14 local-level heads or deputies and three finance experts, advises and coordinates on intergovernmental fiscal matters and meets at least once a year in Chaitra. The federal government may give provinces and local levels binding directions on fiscal matters under Article 232 of the Constitution. Gaps, loopholes and improvement ideas
- Not enforced The federal government cut equalization grants below what the Commission recommended. The Commission reports that, through a clause in the Appropriation Act linking grants to revenue collection against target, equalization grants were reduced by 8.51 per cent for provinces and 8.56 per cent for local levels. It says its recommendation was therefore not implemented. - Unclear Revenue sharing is not fully settled each year. Section 6 requires shared VAT and excise to be paid monthly and reconciled in the last month of the year. The Commission reports that revenue paid into the divisible fund from 16 Asar to the end of Asar 2083 was not shared within that year, so the actual amount shared for the year could not be determined. The Auditor General found the year-end reconciliation also leaves out VAT refunds. - Not enforced Local levels pay administrative costs out of equalization grants. Section 21(4) requires provinces and local levels to budget so that administrative costs are met from their own revenue and revenue sharing. - Not enforced Local levels borrow without federal consent. Section 14 requires provinces and local levels to get federal consent before borrowing internally. The Commission reports that in FY 2082/83, 17 local governments borrowed from the Town Development Fund without it, and the Ministry of Finance said none had asked. - Capacity Transferred money sits unspent while the federal government pays interest on it. The Auditor General found that Rs 1.3244 kharba of fiscal transfers, partly funded by federal borrowing, was lying unspent in provincial and local treasuries and other accounts. At the average internal-debt interest rate, this meant about Rs 5.07 arba a year in extra interest. The Auditor General said the transfer process needs review. Ideas to fix it
- Amend this Act and the NNRFC Act, 2074 so that all fiscal transfers (equalization, conditional, complementary and special grants) follow the Commission's recommendation, as Article 60(3) requires. - Make bigger equalization grants the main transfer and phase out conditional and complementary grants. Provinces should send only equalization grants to local levels, which would require amending this Act. The federal government should budget transfers in line with the resources it can raise and pay them as provinces and local levels actually spend. Where it conflicts with other laws
- Article 60(3) of the Constitution says the amount of fiscal transfers provinces and local levels receive shall be as recommended by the National Natural Resources and Fiscal Commission. Under this Act, only equalization grants are given on the Commission's recommendation. For conditional grants the Commission only sets the bases, and complementary and special grants are left to the federal government's own procedures. The Commission says this Act and its own Act should be amended so that every kind of grant follows its recommendation, and that its repeated suggestions have not been acted on. The Auditor General's 63rd report likewise notes that the law gives the Commission no role in setting grants other than equalization grants.
