What it does
- The Criminal Code (Muluki Apradh Samhita) is Nepal's main penal law, in force since 1 Bhadra 2075 (Section 1(2)). It has three Parts: Part 1 sets general principles of criminal justice, such as no punishment except under law (Sections 6–7), which also apply to offences under other Acts (Section 4), though a special Act governs offences it defines (Section 5); Part 2 lists offences in 27 chapters (plus Chapter 7A on terrorism), from offences against the State to rape, theft, fraud and currency; Part 3 covers privacy and defamation, ending at Section 308. - Rape (Section 219) covers intercourse with a woman without her consent, or with a girl under 18 even with consent; consent obtained by coercion, undue influence, fear or abduction does not count. Marital rape is an offence punishable by up to five years' imprisonment (Section 219(4)). - The Code criminalises untouchability and other caste-based or social discrimination, including barring people from public places, temples or water sources, with up to three years' imprisonment and/or a fine of up to Rs 30,000, plus up to three more months if a public servant commits it (Section 166). Marriage below age 20 is prohibited and void, with up to three years' imprisonment and a fine of up to Rs 30,000 (Section 173). - Part 3 makes invasions of privacy offences, including recording others' conversations, photographing without consent, opening letters and breaching privacy through electronic means (Sections 293–302). Insult (gali) carries up to one year's imprisonment and/or a fine of up to Rs 10,000 (Section 305). Defamation carries up to two years' imprisonment and/or a fine of up to Rs 20,000, plus up to one more year and Rs 10,000 if committed through electronic or other mass media, and the court must order compensation (Sections 306–307). - The 2080 amendment Act on the Muluki Codes (authenticated 2080-04-12) added Section 249A, which bans unfair lending ('anuchit lenden'), such as writing a loan deed for more than was lent, adding interest to the principal, charging interest above the principal, threatening borrowers, or taking a borrower's land through such a deal. It carries up to seven years' imprisonment and a fine of up to Rs 70,000. - The Code defines offences and penalties; investigation and prosecution follow the companion Criminal Procedure Code, 2074. For offences listed in its Schedule 1, anyone who knows of the offence must report it to the nearest police office (Section 4). The police assign an investigating officer and inform the District Government Attorney's office (Section 8). Gaps, loopholes and improvement ideas
- Loophole The UN CEDAW Committee (February 2025) is concerned that the limitation period under the Code is very short: two years to report rape, and three years after a minor turns 18. - Unclear The CEDAW Committee (2025) notes that minors who marry may be prosecuted. Section 173 punishes anyone who marries, or causes a marriage, below age 20, and the Committee recommends ending the criminalisation of minors for under-age marriage. - Unclear In 2019 Human Rights Watch wrote that the revised Penal Code criminalises speech on vague grounds, including that it may 'annoy' or 'trouble' someone, and said limits on speech must be narrowly defined under Nepal's international obligations.
