What it does

  • No one may run a cooperative without registering it under this Act. The Registrar (or an authorised officer) must register a cooperative within 30 days if its by-laws follow the law and it can run on cooperative principles, controlled by its members. The Act has been heavily amended: a 2081 amendment set up a National Cooperative Regulatory Authority and abolished the National Cooperative Development Board, and the Cooperatives (First Amendment) Act 2083 added stricter rules for savings-and-credit cooperatives.   • Cooperatives may take savings from and lend only to their own members, and only cooperatives registered for savings and credit may make it their main business. The gap between savings and loan interest rates may not exceed six percentage points, and interest may not be compounded into the principal. Savings may be lent to members or put only into government bonds or shares of a cooperative bank or a small-farmer microfinance institution, not into land, buildings, businesses or other companies.   • The National Cooperative Regulatory Authority regulates savings-and-credit cooperatives at all three levels of government. It issues national and prudential standards, inspects cooperatives, hears complaints (with some powers of a district court), can order savings to be repaid within a set time, freeze the property and stop foreign travel of directors and others involved in misuse, and fine a cooperative Rs 500,000–1,500,000 and its officials Rs 100,000–500,000, with appeal to the High Court.   • Supervision is split by size. Cooperatives registered at a local level with annual turnover up to Rs 250 million are supervised by that local government; those with Rs 250–500 million turnover, and province-registered cooperatives up to Rs 500 million, by the province; larger ones and federally registered ones by the Department of Cooperatives. Nepal Rastra Bank also supervises cooperatives with more than Rs 500 million in share capital or turnover at the Department's request, but savings-and-credit cooperatives are supervised by the Authority.   • Misusing members' savings, embezzling a cooperative's property, lending to insiders so that the loan cannot be recovered, inflating collateral values, and similar acts are offences. Most are punished by recovering the amount, a fine equal to it and imprisonment rising with the amount involved, up to 8–10 years where it exceeds Rs 1 billion. These are state cases heard by the district court. Gaps, loopholes and improvement ideas

  • Capacity Depositors of failed cooperatives have recovered very little. Under Section 104 the Ministry had declared 23 cooperatives problematic between 2075 and Asar 2082. The Auditor General reported that 79,445 people had claimed Rs 46.96 billion in savings from these cooperatives, but only Rs 2.15 billion (4.59%) had been repaid or settled, leaving Rs 44.80 billion (95.41%) outstanding; 17 of the 23 had not yet completed asset management and payment of liabilities.   • Loophole Savings-and-credit cooperatives grew beyond what weak supervision could handle. The High-Level Economic Reform Commission found that under the 2074 Act some savings-and-credit cooperatives opened branches in big cities across the country and, by abusing weak regulation and supervision, mobilised savings and lent against cooperative principles; all those that became problematic had lent heavily, directly or indirectly, in land, with no single-borrower limit, large shares of loans to one person, and companies admitted as members. The IMF reported continuing failures due to inadequate governance and lack of regulation, causing loss or freezing of savings, with SACCO deposits about one-twelfth of bank deposits and a risk of contagion to small banks.   • Not enforced Most cooperatives do not pay into the Cooperative Promotion Fund. Section 70(2) requires every cooperative to pay 0.5% of its annual net surplus (after the reserve fund) into the Fund. The Auditor General found in two successive years that most of the country's cooperatives (31,450 in 2080/81; 32,965 in 2081/82) had not paid in.   • Capacity Inspection is thin and its follow-up is not recorded. Sections 95–97 let the Registrar inspect, investigate and give binding directions to cooperatives. The Auditor General found that the Department of Cooperatives spent Rs 1.96 million on monitoring in 2081/82 but kept no record of the directions it gave or of whether they were followed.   • Not enforced Anti-money-laundering rules for cooperatives are not enforced. Section 150A requires cooperatives to follow anti-money-laundering directives. Of 71 cooperatives the Department monitored in 2081/82, 23 had no procedures, had not filed threshold transaction reports, or had not assessed risk.   • Not enforced The national cooperative information system is largely unused. The Cooperative Regulation requires larger cooperatives to keep records in the Department's electronic system (COPOMIS). Of 32,965 registered cooperatives, 19,348 (58.69%) had entered data only once and only 13,553 (41.11%) entered aggregate data in 2081/82; the previous year's figures were similar (18,677 and 13,335 of 31,450).   • Not enforced Nepal Rastra Bank's oversight of the largest cooperatives has not been documented. Section 150(6) provides that Nepal Rastra Bank also regulates, inspects and supervises cooperatives with more than Rs 500 million in share capital or turnover, at the Department's request.   • Limit each savings-and-credit cooperative's working area to one local level; allow only natural persons as members; set a single-borrower limit (for now, total loans to one person not above 10% of share capital); ban buying land for resale; allow land loans only for a member without a house, up to 1,000 square metres; cap lending to one purpose or sector at 25% of total loans and the credit-deposit ratio at 90%; and cap savings and loans in locally based cooperatives at Rs 2.5 million.
