What it does

  • The Nepal Citizenship Act 2063 (2006) sets out how Nepali citizenship is acquired and lost. It has been amended four times, most recently by the Nepal Citizenship (First Amendment) Act 2079 (authenticated 2080/02/17) and the Nepal Citizenship (Second Amendment) Act 2082 (authenticated 2082/06/05). A person is a citizen by descent if their father or mother was a Nepali citizen at the time of their birth. Children of people who got citizenship by birth before 2072/06/03 get citizenship by descent at 16 if both parents are citizens; a 2082 amendment covers cases where one parent got citizenship by birth and the other died or is out of contact.   • A person born in Nepal to a Nepali mother and living in Nepal whose father cannot be identified gets citizenship by descent. Since 2082, the father is treated as unidentified if the person and their mother make a self-declaration to that effect, even where a father's name appears on a birth or school certificate. If such a father later turns out to be a foreigner, the person's citizenship by descent is withdrawn and replaced by naturalised citizenship.   • A foreign woman married to a Nepali citizen may apply for naturalised citizenship once she has started renouncing her foreign citizenship; the Act has no equivalent route for a foreign man married to a Nepali woman. Other foreigners may be naturalised only in limited cases (for example after 15 years' residence and a special contribution to Nepal), and honorary citizenship may be given to internationally famous persons.   • Anyone aged 16 or over applies for a citizenship certificate to the prescribed officer, attaching a parent's or close paternal relative's certificate and a recommendation from the municipality or rural municipality; where documents are missing, family members or, failing them, neighbours and local officials can vouch for the applicant on site. Certificates must also show gender identity, and since 2082 an applicant may ask for the father's or mother's name to be left off the certificate, though both remain in the official record.   • Nepali citizenship ends when a person voluntarily takes another country's citizenship, renounces it, or does not choose one citizenship within two years of turning 16; it can be restored on returning and giving up the foreign citizenship. Dual certificates are banned. The government can strip citizenship obtained by a foreigner through false statements (appeal to the High Court within 35 days), and decisions of other officials can be challenged before the Home Secretary. Gaps, loopholes and improvement ideas

  • Outdated Women still cannot pass on citizenship on the same terms as men. In February 2025 the UN CEDAW Committee was concerned that Nepali fathers can confer citizenship on their children and foreign spouses without specific requirements, while women's ability to transmit citizenship through marriage and to their children is limited, and that mothers must make a self-declaration when the father is unknown, with penalties if it is false — which can leave children stateless at birth. The Act mirrors this: a foreign wife of a Nepali man can be naturalised but there is no route for a foreign husband (s. 5(1)); a child of a Nepali mother and foreign father gets naturalised rather than descent citizenship (ss. 3(2), 5(2)); and false self-declarations are criminal offences (s. 21(3क), (3ग)).   • Capacity Children of women whose partner is absent or unidentified, and of some marginalised groups, still face barriers to documents. CEDAW found in 2025 that birth certificates are often not issued in practice when the father is missing or unidentified, that 26% of children under 5 had no birth certificate according to the 2021 census, and that sex workers, Tibetan long-stay migrant women, Bhutanese refugee women and Nepali women married to refugees have limited access to identity documents.   • Loophole Several provisions criticised by the UN Committee on the Rights of the Child in 2016 remain in the current text. The Committee was concerned that descent citizenship can depend on proof that both parents are Nepali citizens; that children of Nepali mothers and foreign fathers do not get citizenship until adulthood, exposing them to statelessness; and that citizenship can be revoked if a previously unidentified father is later proven to be a foreigner. The current Act still requires both parents' certificates in the cases under Section 3(4) and (6) (s. 8(1क)), issues certificates only from age 16 (s. 8(1)), and converts descent citizenship to naturalised citizenship if the father is later found to be foreign (s. 3(7)).   • Loophole The law has no general safeguard for children born in Nepal who would otherwise be stateless. The UN Human Rights Committee regretted in 2014 that Nepal's legislation did not provide nationality for such children, and noted that more than 4 million people then lacked citizenship certificates. Ideas to fix it
