What it does
- No one may survey, generate, transmit or distribute electricity without a licence under this Act. Applicants submit economic, technical and environmental study reports to the prescribed officer, who must issue a survey licence within 30 days and a generation, transmission or distribution licence within 120 days. A survey licence lasts up to five years (a 2082 amendment allows up to two more years where force majeure such as disasters, strikes or curfews prevented the survey), and a generation, transmission or distribution licence up to 50 years. - Hydropower licence holders pay the government a royalty: for the first 15 years of commercial operation, Rs 100 per kilowatt of installed capacity a year plus 2 per cent of the average sale price per unit, and after that Rs 1,000 per kilowatt plus 10 per cent. Where a project is more than 50 per cent foreign-owned, its land, buildings, equipment and structures pass to the government when the licence ends; other projects must be operated under a new agreement with the government after the licence period. - Electricity tariffs and other charges, and the rate at which the government buys bulk power for the national grid, are set by the Electricity Regulatory Commission under its own Act (which replaced the old tariff-fixing committee provisions); the purchase rate must allow the whole investment to be recovered over an average of 25 years. - Generation, transmission and distribution assets may not be nationalised, except that the government may take over hydropower assets of up to 1,000 kW for wider public use on payment of compensation. The government may help licence holders obtain land (leasing government land for the licence period), restrict use of land near power structures with compensation, and enter property after prior notice. Gaps, loopholes and improvement ideas
- Not enforced Many licences are held without projects being built. The Act requires licence holders to comply with licence conditions and allows cancellation for breaches. The Auditor General reported that 451 people and companies held licences to generate 13,534 MW above 1 MW, but only 188 were generating, and that 145 projects licensed more than five years earlier had made no notable progress (some licensed in 2068 and 2070 were at 28 per cent or zero progress). In 2081/82 the Department of Electricity Development monitored only 27 of the 258 licensed projects under construction (plus 15 in operation) and was not found to have given directions on progress. - Not enforced Royalties go uncollected. Of Rs 3.88 billion in hydropower royalty due by 2080/81 (Rs 3.59 billion from 161 companies that year plus earlier arrears), Rs 432.3 million remained unpaid, and no interest or penalty had been charged. In the following year Rs 184.6 million was still outstanding from 149 projects. - Outdated The 1992 Act has not kept up. The Auditor General's performance audit found that because the Act does not cover projects up to 1 MW, generation and connection-fee revenue from them does not reach the treasury; that it is unclear on the deadline for completing construction and (before the 2082 amendment) on extending survey licences; and that its royalty and penalty provisions are outdated and ineffective. The High-Level Economic Reform Commission lists the Electricity Act 2049 among laws not updated in time. - Unclear There are no rules for handing projects over when licences expire. Section 10 transfers majority foreign-owned projects to the government at the end of the licence, and policy requires government involvement two years before handover. The Auditor General found that the 60 MW Khimti and the Upper Bhotekoshi projects were due to pass to the government in 2082/83, but there was no legal framework for the handover process, asset engineering or settling public shareholdings, and the government had not become involved in their operation. - Capacity Too many bodies with overlapping roles. The Department of Electricity Development issues licences, but under the Investment Board Regulation 2069 projects above 200 MW are licensed by the Investment Board, and implementing licences also involves the forest, land and electricity bodies, which the Auditor General says causes procedural delays; it also found the Electricity Regulatory Commission had not fully carried out its responsibilities on open access, transmission and tariff setting and power-purchase methods. Ideas to fix it
